Environmental Law

Understanding. Experience. Competitive Advantage.

A unique aspect of our practice is the broad range of services we offer. We are able to respond to the wide variety of legal circumstances in which clients may find themselves faced with potential environmental liabilities and related risks. We have extensive experience handling problems traditionally associated with environmental law, such as liability stemming from chemical contamination, a petrolium spill or a leaking undergound storage tank. Our experience further lends in our ability to offer sound advice in real estate transactions, corporate mergers and acquisitions, securities offerings, and contract negotiations, all of which can raise significant environmental legal issues.

The environmental lawyers at Richman & Levine, P.C. provide the kind of sophisticated, high-quality legal services traditionally available only at larger firms. With a level of personal attention that can only be achieved at a boutique firm, we offer a wide range of services in all areas of environmental law, from advisory services to due diligence to contract negotiation to litigation. Described below are the touchstones of our practice that ensure excellence and responsiveness in helping our clients manage their risk in a wide range of legal circumstances.

Real Estate Transactions

We have counseled clients in numerous real estate transactions, including acquisitions and divestitures. Among the services we provide are reviewing and evaluating extensive environmental documentation and working with environmental consultants to provide meaningful advice regarding contractual allocation of risk. Our environmental law attorneys have also provided representation and support to clients seeking to undertake Brownfields acquisition and cleanup. We also provide strategic planning advice to clients in divestitures and acquisitions in positioning property in the real estate market.

Commercial Transactions

Complementing our real estate experience, we provide environmental expertise in corporate transactions, both by performing environmental due diligence and in negotiation and contract drafting. We have represented purchasers, sellers and lenders, providing counsel in understanding and evaluating potential risk and quantifying exposures.

Asset Recovery/Insurance Coverage Reimbursement

Insurance coverage for pollution-related losses is natural outgrowth of our litigation services and management of remedial work. We assist our clients in locating, identifying and assembling policies, analyzing available coverage and notifying, negotiating with, and if necessary, litigating against insurance carriers.

We have managed a broad range of remedial work, undertaken both pursuant to governmental requirements and as a result of negotiated agreements among private parties, and ranging from technically complex groundwater remediations to septic system cleanouts. In so doing, we have performed such diverse tasks as working with our clients and consultants to develop a scope of work, seeking competing cost proposals from consultants, and negotiating cleanup standards with government regulators.

Litigation & Dispute Resolution

We have represented numerous property owners, manufacturers and other business operations, both large and small, in litigation and administrative proceedings involving releases of petroleum and hazardous substances, achieving favorable, and even precedent-setting results.

Expert Testimony

Environmental liabilities can be involved in, and even central to, tax certiorari and condemnation proceedings and bankruptcy cases. We have frequently served as special environmental counsel in such matters, developing expert testimony that lays out in detail the environmental conditions of the burdened property and the legal implications of those conditions.
